Co-Tenancy - Contract Module

You can add, edit and delete Co-tenancy clauses associated with a contract. Co-tenancy clauses are often included in contracts where a customer is leasing space in a mall or shopping center. These clauses typically stipulate that the tenant has the right to pay reduced rent or terminate their contract if key tenants or a certain percentage of tenants leave the property. Key tenants could be anchor stores that draw large numbers of customers to the mall or shopping center. This gives lessees financial protection from reduced foot traffic on the property.

  • Click Contract > Abstract Info > Co-Tenancy.

    Use the links in the Navigation Pane on the leftmost side of the page.

ClosedAdd Co-Tenancy Record

  1. Click Add Item.

    This displays in the Actions menu on the right side of the page.

  2. Select the co-tenancy group from the Group field.

    Create a new group or category.

  3. Select the co-tenancy type from the Type field.

    Create a new group or category.

  4. Enter the account number in the Account field.

    In some instances, you may note and alternate account to use when a co-tenancy event triggers alternate rent. This field is information-only.

  5. Enter the following dates:

    • Begin Date

    • End Date

    • Remodel Date

      You can also click Calendar A small button with a picture of a calendar on it. to open the Date Picker and select the appropriate date.

  6. Enter a name for the co-tenancy record in the Name field.

  7. Enter the effective date of the co-tenancy in the Effective Date field.

  8. Enter the rentable area in the Rentable Area field.

    This field can be used to enter the rentable area of the contract or the total rentable area of the property.

  9. Select the area unit used to measure the rentable area from the Area Unit field.

    Create a new group or category.

  10. Enter the required occupancy percentage in the Occupancy Percentage field.

  11. If the co-tenancy clause stipulates a minimum sales number for breaking the contract, enter the sales number in the Sales field.

    For example, some contracts stipulate that if sales drop below a certain number, the lessee has the right to break the contract.

  12. Select the currency for the sales number from the Currency field.

  13. Enter any other financial amount that needs to be captured for co-tenancy purposes in the Other Amount field.

  14. Enter the amount of rent reduction allowed if the occupancy percentage falls below the percentage specified in step 12 in the Rent Reduction field.

  15. Enter the percentage rent reduction allowed if the occupancy percentage falls below the percentage specified in step 12 in the Percent Reduction field.

  16. Select the Has Right to Terminate? check box if you have the right to terminate if the occupancy percentage falls below the percentage specified in step 12.

  17. Enter any comments in the Comments field.

  18. Select the covenant this co-tenancy record is associated with from the Covenant field.

    You can view information about a covenant by selecting a covenant from the field and then clicking the View A small gray button with a magnifying glass on it..

  19. Enter the section of the covenant this co-tenancy record is associated with in the Section field.

  20. Select the amendment this co-tenancy record is associated with from the Amendment field.

    You can view information about an amendment by selecting an amendment from the field and then clicking the View A small gray button with a magnifying glass on it. .

  21. Click Save Changes.

    This displays in the Actions menu on the right side of the page.

    The page refreshes. The co-tenancy record is added to the Contract Co-Tenancy List.

ClosedEdit Co-Tenancy Record

  1. Select the record you want to edit from the Contract Co-Tenancy List.

  2. Make your changes.

  3. Click Save Changes.

    This displays in the Actions menu on the right side of the page.

    The page refreshes. Your changes are saved.

ClosedDelete Co-Tenancy Record

  1. Select the record you want to delete from the Contract Co-Tenancy List.

  2. Click Delete Item.

    This displays in the Actions menu on the right side of the page.

    A dialog opens, asking you to confirm your choice.

  3. Click Yes.

    The page refreshes. The co-tenancy record is deleted.
